UPDATE: Deputy Resigns Following Walmart Shooting

MORGAN COUNTY, Ala. - UPDATE: Morgan County Sheriff Ana Franklin confirms Deputy Brian Fulford has resigned, following a meeting with her department.

This comes after he was charged with assault for firing at a wanted suspect in a Walmart parking lot.

A Morgan County Deputy is charged with assault after a shooing Tuesday at a Huntsville Walmart.

Deputy Brian Fulford is facing assault 2nd degree after the Huntsville Police Department released their findings to the Madison County District Attorney.

Sheriff Ana Franklin says Fulford turned himself in after a warrant had been issued, Friday.

Officials say Deputy Fulford attempted to arrest David Horton while off-duty at the Walmart. Horton was wanted on a felony charge in Morgan County. We're told Fulford fired a shot. Horton was taken to Huntsville Hospital with non-life threatening injuries. Horton was booked on his felony charges.

Fulford was given a $5,000 bond and has been released.

Huntsville Police say Sheriff Ana Franklin and her staff cooperated in the investigation.

Sheriff Franklin says Fulford has been placed on non-paid administrative leave pending a meeting with the Sheriff's Office on Monday.
