
Madison County Circuit Court Judge Karen Hall is allowing statements Jacob Shaffer made to a Lincoln County Sheriff's Office sergeant to be used in his upcoming Capital Murder trial in Huntsville.
However, she ruled that statements Shaffer made to Madison County investigators and a Tennessee Bureau of Investigation agent are not admissible as evidence against him.
Shaffer is already serving five life sentences in Tennessee for killing five people. His trial for the 2009 murder of Sidney Dempsey in Huntsville is scheduled to begin Oct. 29.
According to court documents filed by Shaffer's attorneys, Shaffer asked for an attorney during an interview with the TBI agent. Two Madison County investigators also spoke with Shaffer after he had asked for an attorney.
Dempsey was found dead in his marble shop. Investigators believe Shaffer killed Dempsey before going to Tennessee to kill his estranged wife, her son, two other family members and a neighbor.
Madison County prosecutors are seeking the death penalty.
